Vission

1 Samuel 17:45-47
(45) David answered: You’ve come out to fight me with a sword and a spear and a dagger. But I’ve come out to fight you in the name of the LORD All-Powerful. He is the God of Israel’s army, and you have insulted him too! (46) Today the LORD will help me defeat you. I’ll knock you down and cut off your head, and I’ll feed the bodies of the other Philistine soldiers to the birds and wild animals. Then the whole world will know that Israel has a real God. (47) Everybody here will see that the LORD doesn’t need swords or spears to save his people. The LORD always wins his battles, and he will help us defeat you.

5 Keys to Courage: 4: Vision
David had a why, a vision, an end in mind, a purpose and that fueled the fire that was burning in his heart. Many of us become faint at heart because we focus on the disadvantages and the more we do so the bigger they seem to us.

Our vision, our why is not convincing enough and so in the midst of adversity we give up. But not David. Goliath was a giant, way bigger than the average man. David was a teenager, just a boy as King Saul reminded him.

Goliath was a trained soldier he had the skill the strength and the strategy. David was a simple shepherd boy with no military training.

Goliath had weapons that would tear a man apart with one swing; he had body armor to protect him a shield to block any attacks directed towards him. David had a stick, a sling and 5 smooth stones and most importantly he had God,s backing because he had a divine vision, a divine why!

David says to Goliath, the reason why I will kill you and cut off your head is simply one….not so that I can be famous or prove to the world that I am stronger than you, God will give me the strength to take you down so that the whole world will know that Israel has a real God.

Everybody here will see that the LORD doesn’t need swords or spears to save his people. The LORD always wins his battles, and he will help us defeat you.

David’s vision was to please God, his why was so that God would be glorified. Through this his people Israel were reminded that though they were afraid and in hiding, God was right there with them all along and He had already given them the victory all they had to do was go out in faith and fight.

The fight was fixed! As for the philistines they would know that the God of Israel is the one true God the God who can empower a simple boy with a sling and stones to kill Goliath their champion a well-trained soldier with just one strike.

Now that’s the God I serve and may all I do seek to glorify him and not me. Why are you doing what you are doing, what’s your vision?

Courage to Win

PLAGIARISM AS A RESEARCH TOPIC IN COMMUNICATION LAW AND ETHICS

Introduction

Communications is a branch of knowledge dealing with the principles and methods by which

information is conveyed.  It deals with the exchange and flow of information and ideas from one

person to another; it involves a sender transmitting an idea, information or feeling to a receiver.

Effective communication occurs only if the receiver understands the exact information or idea

that the sender intended to transmit (Berlo, 1960).

According to Hart (1961), Law is generally a system of rules which are enforced through social

institutions to govern behaviour. It is made of system of rules which a particular country or

community recognizes as regulating the actions of its members and which it may enforce by the

imposition of penalties.  It is possible to describe law as the body of official rules and

regulations, generally found in constitutions, legislation, judicial opinions, and the like, that is

used to govern a society and to control the behaviour of its members.

Therefore, communication laws are rules and regulation that govern and control the exchange of

information. The communication laws form a forms a formal mechanism of social control in

media and other communication channels.

Ethic is the is a branch of philosophy that involves systematizing, defending and recommending

concepts of right and wrong conduct, often addressing disputes of moral diversity (Perle, 2004).

Communication laws are used to enforce and guide the practitioners in the communication field

of how to be ethical in their practice. Communication ethics govern a person's or group's

behaviour in communication. Thus, communication process is guided by laws and ethics.

Practices like plagiarism, unauthorized duplication, transfer, use and sharing of communication

materials without the authors’ permission are considered to be unethical and unlawful in

communication

PLAGIARISM

 In the 1st century, the use of the Latin word plagiarius (literally kidnapper) to denote stealing

someone else's work was pioneered by Roman poet Martial, who complained that another poet

had "kidnapped his verses." "Plagiary", a derivative of "plagiarus" was introduced into English

in 1601 by dramatist Ben Jonson to describe someone guilty of literary theft (Valpy, 2005).

The derived form plagiarism was introduced into English around 1620. The Latin plagiārius,

"kidnapper", and plagium, "kidnapping", has the root plaga ("snare", "net"), based on the Indo-

European root *-plak, "to weave" (seen for instance in Greek plekein, Bulgarian "плета" pleta,

Latin plectere, all meaning "to weave") (Valpy, 2005).

According to Blum (2010), Plagiarism is the wrongful appropriation and stealing and publication

of another author's language, thoughts, ideas, or expressions and the representation of them as

one's own original work. It is the practice of taking someone else's work or ideas and passing

them off as one's own. Pplagiarism occurs when a writer deliberately uses someone else’s

language, ideas, or other original (not common-knowledge) material without acknowledging its

source.

The modern concept of plagiarism as immoral and originality as an ideal emerged in Europe only

in the 18th century, particularly with the Romantic Movement.  Today, plagiarism is not only an

academic crime but its has spread to the creative fiction and non fiction works. Today, articles

and papers are plagiarized as well. This has spread into the fiction world where people pick

characters, storyline or even an entire novel or play and claim ownership (Kock and Davison,

2003).

In communication studies, plagiarism is considered academic dishonesty and a breach of

journalistic ethics. It is subject to sanctions like penalties, suspension, and even expulsion.

However, Plagiarism is not a crime per se but in academia and industry, it is a serious ethical

offense. In most occurrences Cases of plagiarism can constitute copyright infringement (Lands,

1999). Plagiarism is however widely considered as unethical and is a serious offence in all

institutions of learning as well as within most professions.

Academic Discussions on Plagiarism

Plagiarism applies to texts published in print or on-line, to manuscripts, and to the work of other

scholars and writers. The most current discussions of plagiarism fail to distinguish between

Lifting and poor citation.

1. Lifting

This is Submitting someone else’s text as one’s own or attempting to blur the line between one’s

own ideas or words and those borrowed from another source. Copying someone else’s work,

either sections or word for word and claiming originality.  The use of someone else’s work

without attribution, whether deliberately or thoughtlessly is  a serious ethical breach. Lifting is

mostly involves copyrighted works; original thoughts made real expressions such as words or

audio visual (Blum 2010).

2. Poor Citation

Directly quoted works or pieces from sources other than the writer’s own reporting should be

attributed. Whenever other work is used as source of ideas for stylistic inspiration the final result

must be properly attributed. Failure to give attribution is considered as plagiarism. In addition,

careless or inadequate citing of ideas and words borrowed from another source is a plagiarism

case. All citation must be done through the approved standards such as APA and Havard

referencing (Blum 2010).

Plagiarism VS Copyright Infringement

The key distinguishing factor is the use intended. A copyright infringer copy-pastes, performs,

broadcasts, reproduces, translates your work in order to derive some commercial benefit. On the

other hand, plagiarizer copy-pastes, performs, broadcasts, reproduces, translates your work in

order to assume your identity as the author for purposes of recognition and attribution (Jones,

2006).

Therefore every case of copyright infringement can also be plagiarism but not all cases of

plagiarism amount to copyright infringement. So the law rightly recognizes copyright

infringement as a criminal offence but not plagiarism.

It is important to remember that there are several types of uses of copyright work that are

allowed under the ‘fair dealing’ provisions of  many Copyright Acts. These include criticism,

review, scientific research, educational uses, private use and reporting of current events for as

long as you as the author are acknowledged as such (Lands, 1999).

An example is the High Court ruling in the case of Njeri Wangari & Another v. Oxford

University Press (E.A) Ltd. [2012] eKLR. The judge’s decision dismissed the claims of

copyright infringement. Although the court acknowledged that Njeri Wangari (Kenyan Poet) was

the copyright owner of the poem, it failed to award her any compensation for copyright

infringement on the basis of a technicality. This case qualified Oxford University Press (E.A) Ltd

actions as copyright infringement instead of plagiarism or both (Kenyan Poet, 2014).

In another case, Kenyan media Personality Caroline Mutoko who in her weekly column in the

Star newspaper of  September 3rd 2012 , lifted every word from a post  titled ‘Letter to My 20-

Something Self’ that  had appeared on a blog run by the Crunk Feminist Collective. She did not

even bother to change the title. In an even more ironic twist, she ended her post with the warning

“The Internet Never Forgives” (Kenyan Poet, 2014).

 The Internet

 As mentioned by Jones (2006), the growth the internet has been heralded as a double edged

sword with respect to plagiarism. On one hand the availability of a multitude of information

websites including websites that avail term papers to students for a relatively small fee have left

universities across the world scratching their heads on how to fight the vice. On the other hand it

has provided a variety of free tools that help identify plagiarism.

Uploading your work online increases your visibility but also puts you at risk of plagiarism and

copyright infringement. As far as protection goes, creators of online digital works are

encouraged to add a generic tag of “(c) (author’s name) + (year of publication) + All Rights

Reserved” at the end of every work you upload online. Your contact details should also be easily

accessible both on each individual work and on your site/blog in case attempts are made by a

third party to contact you regarding consent to use your copyright work.

In the age of the internet, surveillance and monitoring of your copyright work has been made

somewhat easier. For instance, using search engines to search for your name and/or the name of

your work(s) allows you to track where and how your work has been cited, mentioned or even

copied by others. In addition, most private users of digital copyright works could also serve as

your eyes and ears and help you as the copyright owner spot unauthorized uses of your work(s)

on the internet.

Plagiarism Elimination Debates

The debate around plagiarism, online sharing and distribution of e-books, articles, papers and

other communication and academic materials is sharing of profit or any other income made Kock

and Davison (2003). Plagiarism can only be addressed through acknowledging source of

information.  Any income earned form works that have cited other authors should be shared

among all the authors involved. However, Kock and  Davison does not consider the all the other

factors involved in producing, marketing and sharing of such works by the author.

It is hard to determine the original source of some stories, poems and songs. This has been a

challenge even in obtaining copyright. The solution lies in computer mediated solution (Postmes

and Lea, 1994).  This argument has been supported by Kock (2004), in his new theory of

Computer mediated communication based on Darwian evolution.

Woolgar (1991), proposes use of technology to deal with plagiarism and unauthorized sharing of

books online. The first achievement in combating plagiarism and unauthorized sharing of files is

by converting study of technology into a social science study. This will involve study of human

values even in technology. Through socialization readers will learn to appreciate the works of

authors and will respect the authors. This will enhance responsibility in sharing of e-books and

will eliminate plagiarism.

The debate on plagiarism and unauthorized sharing of e-books is further informed by Bijker and

Law, (2003) who argue that it is by shaping technology to fit into social norms and values that

we are able to build the society. Thus, plagiarism and unauthorized sharing of e- books should be

shaped in order for the transition from print to digital versions of e-books to be of use to the

society.

The solutions offered by communication scholars to curb plagiarism and unauthorized sharing of

e-books are appropriate. It is agreeable that by using social norms together with high tech

softwares plagiarism and unauthorized sharing can be eliminated. This will give authors a global

audience and enhance appreciation and professionalism among them. Thus, authors will be able

to fully benefit from the advantages of e-books and other online  writing platforms.

CONCLUSION

Plagiarism is a major concern in communication law and ethics. Plagiarism is a breach of ethics

and it is a crime. The solutions offered by scholars should be used to curb it. Whether it is done

consciously or unconsciously, the proprietors should be punished appropriately.

It is important for authors to upload their works online and develop e-books so as to use the

widely available online audience. This will empower their writings and help them to share their

ideas with the world. The authors should be able to protect themselves from plagiarism and

unauthorized sharing of their books through soft wares as per the computer mediated Theory

The Kenyan authors should use the available software’s to protect their works from

redistribution, plagiarism and unauthorized sharing of information. This will protect them from

incurring losses and present a chance of increasing their incomes.

Update Your Software

The first step to living a transformed life is changing how we think and what we believe and if the enemy can get you and still living life on the old software then our lives will never really be changed because remember without faith it is impossible to please God and faith without works is dead.

It is like living in a palace having been adopted as a child of the king with everything at your disposal yet you still live like a street urchin because your way of thinking (software) was never upgraded.

Every now and then when my phone connects to wifi it alerts me if there is an upgrade on some of the software’s that run my phone. The same thing happen to my spiritual man when I read the bible, attend a fellowship or a church service.

The Fight is Fixed

The Fight is fixed
Imagine you are a boxer and you have a title fight, but the good thing about this fight, is that the fight is fixed. You have the guarantee that you will win the fight and that has gotten you so excited.

You go off announcing to all your friends how you are the champion and how your opponent does not stand a chance. In the midst of all the announcing and the celebration, you lose track of time and you end up not showing for the fight.

In your absence you end up forfeiting the fight and though you had the guarantee of winning because the fight was fixed, you end up losing the fight.

How do you lose a fixed fight? It is like doing an exam that already had all the answers marked out but you still don’t make the pass mark.

The children of Israel are just about to begin possessing the land the Lord promised their fore father Abraham. God tells them that the city is theirs to take, He has already given them the strategy, and it is a done deal.

What do you think would have happened had the Israelites not showed up for the fight? The walls of Jericho would have remained standing.

God had done his part and now the Israelite had their part to do, they have to go in there and fight. Many of us are losing a battle that we have a guarantee to win because we are not showing up for the fight, and even when we do, we run away or give up the moment we encounter a little resistance.

We expect to walk around out Jericho, shout, the walls come tumbling down and as soon as that happens, the inhabitants of Jericho take off and leave everything to us. That is not what happened when Joshua was given the guarantee over Jericho.

Joshua 6:20 The priests blew their trumpets again, and the soldiers shouted as loud as they could. The walls of Jericho fell flat. Then the soldiers rushed up the hill, went straight into the town, and captured it.

They killed everyone, men and women, young and old, everyone except Rahab and the others in her house. They even killed every cow, sheep, and donkey.

Now, do you think that the inhabitants of Jericho just stood by and waited for the Israelite's to come by and kill them? I don’t think so. They must have fought back and tried to defend themselves. I am sure that in the process some of the Israelite's must have gotten some injuries.

Yes God has given us the victory and we have the assurance of the outcome of the fight, but that does not mean that we don’t show up for the fight.

We have to show up, and not only that, we have to get into the ring and fight and in the process we will have some blows rained on us, but in the end we have the assurance of victory.

Show up for the fight and get into the ring and even if you are knocked around a bit, don’t lose heart hang in there…the fight is fixe

Would Accept The Worst of Me ?

A relationship is not about having a handsome boyfriend or a beautiful girlfriend. Its not about looking for a perfect person because there is no perfect person on earth. Its not about looking for a rich person or a well off person cause money can't buy Love. A relationship is finding someone who respects you, who is proud of having you, who loves you the way you are, who is faithful to you, who knows how to comfort you, who knows how to encourage you and would accept the worst of you and will go through everything without giving up on you.
Such people are rare but if you have one, just handle that person with extra care.

Despising your blessing
One foggy night in London, many years ago, a ragged unkempt man shuffled into a little music shop, owned by a Mr. Betts. Clutched under the man's arm was a violin. "Will you buy this old violin from me?" the man muttered.

I'm starving. I need money to buy something to eat." "Well, I already have several violins," Mr. Betts replied. "But I don't want to see you go hungry. Will $5.00 help you out?" "Oh, yes," said the man. "Thank you. Thank you."

He took the money and disappeared into the night. Mr. Betts picked up the violin, took the bow and drew it across the strings. The violin gave forth a deep mellow tone. Surprised, Mr. Betts took a light and peered into the inside of the violin.

He could hardly believe what he saw. There, carved into the wood were these words: "Antonio Stradivari...1704." Mr. Betts ran out into the street to find the old man, to pay him more for the violin. But he had gone. I read this story and I was reminded of someone in the bible who faced somewhat of the same situation.

Esau did not see the value of his birthright at the time when he was hungry, but later on as you read the story, he was ready to kill his brother when he realized he had been conned of his blessing.

Many of us despise the very thing that the Lord has placed in our hands because we are busy observing what other people around us have.

Like the beggar in the story, you have something in your hand but you have no idea how much it is worth and so you continue living a miserable life. Or maybe someone else has realized the value of what you have in your hand and because you see no value in it, you are being exploited and you have no idea what is happening.

I have also realized that the thing that God puts in your hand requires a particular environment to reap the most benefit from it. To the beggar in the streets the violin was not worth much and it could have passed off to any passerby as an old piece of junk, but in the right environment it was worth so much more!

Reminds me of a lady who did not have a lot in terms of academic qualifications but the one thing she could do well was to braid hair. Now in her neighborhood all she got for doing that was a few coins and many times she did it as a favor to her friends and family.

Eventually she got an opportunity to visit a friend in the states and she discovered that not many people could plait hair the way that she could. She began plaiting hair and she was paid huge amounts of money she could not believe it! She ended up settling there and setting up a beauty shop.

What do you have? Are you despising it like Esau? Do you even know what you have?

How to react when you are angered?

Galatians 5:22-23 But the fruit of the Spirit is love, joy, peace, forbearance, kindness, goodness, faithfulness, gentleness and self–control. Against such there is no law.

The question you and I need to ask ourselves is what kind of fruit are we bearing? Is it fruit that is acceptable before God, or are we bearing diseased fruit that looks great from the outside and all manner of people are praising you yet on the inside it is full of worms and disease?

Nothing about us is good and as long as we do not die to self, then the Spirit of God cannot birth the fruit that God needs to see in us. Knowing what we know, it would be sad for you and I to be among the number that almost made it to heaven. This calls for some self evaluation, look within you and ask what kind of fruit is growing in you?

How do you react when you are angered? What comes to the surface when you are treated unjustly? It is in such heated moments that the fruit in you is exposed for all to see. Lets not fool ourselves, we are living in the last days and the time to play church has run out.

Like the thief on the cross who said “remember me when you get into your kingdom” lets be among those who almost made it to heaven.

President's Official

President's Official

A lowly shepherd because of his devotion and faithfulness to the king was suddenly promoted as one of the king’s high officials. His appointment caused quite some jealousy among some of the ministers and they made sure they made known their concerns to the king.

How could a simple shepherd be of a higher rank than them? The king heard them out and said “He is my most faithful and trustworthy servant and I have every confidence in him. But in order to satisfy your minds, watch him and his ways and if there is anything that is not right, let me know."

As they watched the official they noticed that once every week, he went into a room and locked himself in for an hour. They reported this to the king saying that the official was planning something evil against the king.

The king gave them permission to search the room and when they did, all they found was a parcel with old peasant clothes in the room. They took this to the king who summoned for his official to explain what this was all about.

The official answered and said, "Those are the shoes and that is the dress I used to wear when I was a shepherd. I open them out and look at them once a week lest I should forget what I once was and how unworthy I am of all the kindness and honour your majesty has bestowed upon me."

Use good sense and measure yourself by the amount of faith that God has given you. We were all in the gutter filthy and smelly before the Lord picked us up washed us by His blood and clothed us in robes of righteousness. It was not because of what we had done, but rather because of what He had done for us.

Many times we forget where we have come from and we think it is all about us. We begin to look down on others who may not be as blessed as we are.

We forget that God washed us up so that we can serve others and instead we manipulate others so they can serve us because though we never really say it, we sometimes think we are better than they are.
Romans 12:3
"I realize how kind God has been to me, and so I tell each of you not to think you are better than you really are. "

May we take a lesson for the lowly shepherd who became the kings official. Once in a while may we look at the old shoes and the filthy clothes we used to wear to remind ourselves lest we forget who we once were and how unworthy we are of Gods kindness and grace and yet He still gave it to us.

Stay On Your Own Lane And Forge Ahead

You were born in a first class hospital, I was
delivered at home, we both survived. You went
to a private primary school and I went to a
public school, we both ended in the same high
school. You woke up from the bed and I woke
from the floor, we both had a peaceful night rest. Your outfits are all expensive, mine are all
simple and cheap, we both still cover our
nakedness. You ate fried rice and roasted
chicken, I ate ugali and omena but we both still
ate to our satisfaction. You ride on Lexus jeep,
Range Rover, G Wagon, Hummer Jeep and I use public transport but we still got to our various
destination.

Iphone6+ and I typed it with my Ideos, we still
see the message. Lifestyle is not a competition and there are different ways to get a lot of
things done, different lanes all leading to the
same destination. Just because your neighbour
is doing things faster does not mean you are
failing. Happiness doesn't come from having
everything, but from making the best out of by what you have, it's all about how you see
yourself. Stay on your own lane and forge

My mum, my siblings and I lived in a single room for many years. Probably, I would still be there today, were it not for my curiosity that drove me to visit friends in other parts of Nairobi. I was impressed by the hygiene and how things looked clean and orderly outside the ghetto. This stirred me up and challenged me to change my life. I can actually trace the journey of my life to a single decision to change that I made many years ago. I can attest that the life you envision must first become actualised through change if the benefits you desire are to accrue to you. The great and mighty, the rich and famous were never born that way. Often, they grew through change, adjustments and adapting to new frontiers that ultimately brought them to their current positions.
A majority of people only wish for a better life, stable relationships, promotion in career, better income, but very few people are willing to make the necessary adjustments to realise these wishes. In this life, you either live by the pain of change or by the pain of regret. The choice of pain must constantly be made. Archbishop Leon Joseph said: “Happy are those who dream dreams and are willing to pay the price to make them come true.” Some environments have a genuine stigma attached to them. While some may fuel bad habits, others have long exhausted all available potency for success and the only option is for somebody who wants more to leave that environment for a more conducive one.
The familiarity of mediocrity, the acceptance of poor standards and the absence of a competitive atmosphere in any environment has the ability to cripple an otherwise fertile potential. When you find yourself in places where the normal is celebrated and village champions are the ultimate celebrities, you need to run, because in such places, your gift will not flourish and will soon die. Stop limiting yourself to the familiar, the comfortable and the predictable environments where you can easily manoeuvre without much effort. Move to the unknown and challenge yourself to become creative and adaptable. If your environment is not challenging, then you need to consider relocation to a more challenging environment. Expose yourself to an environment that rebukes your mediocrity and challenges you to become better.
Did you know that the words you speak have the power to become reality? What you say about yourself has the ability and the capability to manifest tangible experiences in your life. Watching what you say and guarding what you hear may be one of the foremost steps towards determining the outcomes of your life. The words you speak out of the convictions of your heart have grace that is strong enough to lubricate life and its challenges. Develop a sieve that selects your words and believe in your heart that the positive confessions you make over yourself have transformational power. What is continually in your heart will soon find itself in your mouth and what is in your mouth will soon find its way into your heart. Whatever the mouth says, the heart begins to believe. As ridiculous as it may sound, the fact of the matter is that you can speak what you want to see and you shall have whatever you say.
 Albert Einstein said that: “We cannot solve problems with the same way of thinking we used when we created them.” The bad and the ugly situations around your life are not waiting for a shift of prevailing circumstances. They are waiting for the change of your mind. Situations are created, sustained and terminated by the mind before they can manifest in actual reality.
There is nothing that a change of mind cannot alter. Anything you are experiencing is because in your mind, you have allowed it. Take time to disallow poverty, failure, rejection and addictions by changing your mind. You may be in a slum physically, but that does not stop your mind from being in a leafy suburb.
People don’t die in squalor because money stopped circulating. They do because from where they stood, there was no perspective of a way out. If you don’t like where you are, change it! I love you and I am always praying for you.
